وسط حضور كبير من ممثلي البعثات والمسئولين الأمميين والإعلاميين ومنظمات المجتمع المدني ، عقد تحالف منظمات المجتمع المدني المصري  من أجل الاستعراض الدوري الشامل  ندوة بمقر الأمم المتحدة بجنيف على هامش اجتماعات الدورة 34 لمجلس حقوق الإنسان التابع للأمم المتحدة وذلك يوم الخميس 23 مارس 2017 .

شهدت الندوة الكشف عن التقرير الذي أعده التحالف لتقييم أوضاع حقوق الإنسان في مصر في ضوء توصيات الاستعراض الدوري الشامل ” والذي يغطي الفترة من مارس 2015 وحتى نهاية يناير 2017 ، وهو تقرير تقييم منتصف المدة لمتابعة مدى التزام الحكومة المصرية بتنفيذ التوصيات التي قبلتها خلال خضوعها لعملية الاستعراض الدوري الشامل قبل عامين .

بدأت الندوة بكلمة ترحيب وتعريف بالتحالف للأستاذ أيمن عقيل  رئيس مؤسسة ماعت للسلام والتنمية وحقوق الإنسان ، والأمين العام للتحالف ، حيث أشار خلالها إلى أن التحالف يعتبر مخرج مهم من مخرجات مشروع الاستعراض الدوري الشامل كأداة لتحسين السياسات العامة خلال المرحلة الانتقالية الذي تنفذه مؤسسة ماعت بتمويل من الإتحاد الأوروبي ، وأكد عقيل على أن المنهجية التي يتبناها التحالف كوسيلة للتغيير وتحسين أوضاع حقوق الإنسان هي ” الحوار ” والفصل بين ما هو سياسي وما هو حقوقي ، والعمل تحت مظلة القانون حتى لو كانت أحكامه غير مواتية مع السعي لتغيير هذه الأحكام بالطرق المشروعة .

وبعد ذلك تناول عقيل في كلمة مفصلة بعض المحاور المتعلقة بالحقوق المدنية والسياسية والتي وردت في التقرير ، وأشار إلى أن التطورات في محاور مكافحة الإرهاب ، وسلوك جهات إنفاذ القانون ، والحق في التنظيم والتجمع السلمي ، تتسم بأن لها جوانب إيجابية وجوانب سلبية في نفس الوقت ، وضرب المثل بتعدد وقائع إحالة الضباط المتورطين في التعذيب للمحاكمات وصدور أحكام قاسية على بعضهم وهو ملمح إيجابي ، إلا أن الجانب السلبي هو عدم تعديل تعريف جريمة التعذيب في قانون العقوبات حتى الآن .

وفيما يتعلق بمكافحة الإرهاب قال عقيل  أن الدولة في مصر تخوض حرب حقيقية ضد الإرهاب الذي يهدد مناطق مختلفة من العالم  ،وأشار إلى  ضرورة تكاتف جهود المجتمع الدولي وتبني وثيقة حقوقية ملزمة من اجل مناهضة العنف والتطرف والإرهاب ، إلا أن ذلك يجب أن يتواكب مع احترام حقوق الإنسان وعدم توسيع دائرة الاشتباه والتحفظ .

تحدث في اللقاء أيضا الدكتور ولاء جاد الكريم الأمين العام لمؤسسة شركاء من أجل الشفافية ونائب رئيس مجلس أمناء التحالف ، ومقرر لجنة إعداد التقرير ، حيث استعرض المنهجية التشاركية التي تم استخدامها  خلال مراحل إعداد التقرير حتى يكون معبرا عن وجهة نظر كافة أعضاء التحالف ال229  ، وأشار إلى أن التقرير يعتمد على التوصيات التي قبلتها الحكومة المصرية كليا وجزئيا أو أخذت بها علم ، وينقسم إلى 25 محور تغطي كافة القضايا موضع التوصيات ، حيث يرصد كل محور الإطار الدستوري والتطورات التشريعية والإجرائية ذات الصلة خلال الفترة التي يغطيها التقرير .

كما تناول جاد الكريم في كلمته بعض المحاور الواردة في التقرير المتعلقة بحرية العقيدة وحرية الرأي والتعبير ومكافحة الفساد والحقوق الاقتصادية والاجتماعية ، مشيرا إلى حاجة الأطر التشريعية إلى مزيد من التعديل لتتواكب مع متطلبات الوفاء بتعهدات الحكومة المصرية أمام آلية الاستعراض الدوري الشامل في هذه المحاور ، ونوه إلى أن السياسات العامة المتبناه وعمليات إعادة الهيكلة والإصلاح المالي كان لها تأثير سلبي ملموس على معدلات الإنفاق الحكومي على الخدمات الاجتماعية خاصة قطاعات الصحة والتعليم .

كما تحدث الدكتورة مي التلاوي رئيس مؤسسة القيادات المصرية من أجل التنمية عضو التحالف عن  المحاور الخاصة بالمرأة والطفل وذوى الإعاقة والشباب في التقرير ، حيث أشارت إلى أنه تم رصد تطورات تشريعية فيما يتعلق بمناهضة ختان الإناث ، والحقوق التعليمية لذوى الإعاقة ، كما تم تبني إجراءات لمعالجة قضية أطفال الشوارع ، إلا أن ذلك لم يكن كافيا ، فلازالت مشكلة عمالة الأطفال في المهن الخطرة قائمة ، وهناك قصور في استفادة ذوى الإعاقة من فرص العمل ، كما أن العنف المنزلي ضد المرأة لازال غير مجرم.

وقدمت الأستاذة فاطمة عثمان  مدير مشروع الاستعراض الدوري الشامل كأداة لتحسين السياسات العامة بمؤسسة ماعت عرضا عامل للمشروع وفرص الدعم التقني التي يقدمها لمنظمات المجتمع المدني المصرية ، وقالت أن التحالف يعد النشاط المركزي للمشروع ويعمل باستقلالية تامة من خلال مجلس أمناء منتخب انتخابا مباشرا من أعضائه ، وأشارت إلى أن التقرير سيكون متاحا من الغد على الموقع الإلكتروني لمؤسسة ماعت للسلام والتنمية وحقوق الإنسان وسيرسل لكافة أصحاب المصلحة والمعنيين .

In the midst of a large presence of representatives of missions, international officials, media and civil society organizations, the Egyptian Civil Society Coalition for the UPR held a massive seminar at the United Nations Headquarters in Geneva in parallel with the 34th session of the UN Human Rights Council on Thursday, March 23, 2017.

 

The seminar witnessed the publication of the report prepared by the Coalition for the assessment of the human rights situation in Egypt in light of the UPR recommendations, covering the period between March 2015 and January 2017. It is a mid-term evaluation report in order to follow up the Egyptian government’s commitment to implement the accepted recommendations during its review process in the UPR two years ago.

The seminar began with a welcome speech and a definition of the coalition by Mr. Ayman Okeil,  the head of the Maat for Peace, Development and Human Rights, and the General Secretary of the coalition. He pointed out that the coalition is an important outcome of the “Universal Periodic Review as a tool to Enhance public policy during the transitional period” project funded by the European Union. He stressed that the methodology adopted by the coalition as a means of change and improvement of the human rights situation is “dialogue”, in addition to the separation between politics and human rights and working under the umbrella of the law even if its provisions are unfavorable, while seeking to change these provisions through legitimate means.

Okeil then discussed in a detailed speech some of the topics related to civil and political rights mentioned in the report. He pointed out that developments in the fields of combating terrorism, the behavior of law enforcement agencies and the right to peaceful organization and assembly which are having positive and negative aspects at the same time. Indeed, the fact that the officers involved in torture are referred to trials and harsh sentences is positive, but the negative aspect is that the definition of torture in the Penal Code has not yet been amended.

Regarding the fight against terrorism, Okeil said that the Egyptian state is having a real war against terrorism that threatens different parts of the world and he pointed out to the need for concerted efforts by the international community and the adoption of a binding human rights document against violence, extremism and terrorism while respecting human rights and avoiding to expand the circle of suspicion and reservation.

 

Dr. Walaa Gad Al-Karim, Secretary General of Partners for Transparency and Vice-Chairman of the Board of Trustees of the Coalition and Rapporteur of the Report Preparation Committee, reviewed the participatory methodology used during the preparation of the report to reflect the views of all 229 members of the Coalition. The report is based on recommendations that were accepted by the Egyptian government in whole or partly or taken into account. It is divided into 25 axes covering all the issues that are the subject of the recommendations. Each axis focuses on the constitutional framework and related legislative and procedural developments during the period covered by the report.

In his speech, Gad Al-Kareem discussed some of the topics mentioned in the report concerning freedom of belief, freedom of opinion and expression, combating corruption and economic and social rights. He pointed out to the need of legislative amendments to be compliant with the Egyptian government’s commitments to the Universal Periodic Review mechanism in these axes. He also noted that adopted public policies, restructuring and financial reform operations have had a significant negative impact on the rates of government spending on social services, especially health and education.

Dr. Mai Talawi, President of the Egyptian Leadership for Development Organization, spoke about the issues related to women, children, persons with disabilities and youth in the report. She noted that legislative developments have been monitored concerning  combating FGM and educational rights for persons with disabilities, as well as the measures that have been adopted to address the issue of street children. However, this has not been sufficient. The problem of child labor in the hazardous professions is still standing, there is a lack of employment opportunities for persons with disabilities, and domestic violence against women is still not criminalized.

Ms. Fatima Othman, Director of the Universal Periodic Review as a tool to enhance public policiy at Maat, presented the project and the technical support offered to the Egyptian civil society. She said that the coalition is a central activity of the project and operates independently through a board of trustees elected directly by its members. She pointed out that the report will be available from tomorrow on the website of the Maat Foundation for Peace, Development and Human Rights and it will be sent to all stakeholders.
